Supreme Court Says Tax Must Follow Product’s Form at Sale, Not Its End Use
The Supreme Court has ruled that tax classification must be determined by a product’s physical form at the point of sale, not by how it may ultimately be used. In a significant setback for the revenue department, the court dismissed appeals seeking to tax Cadila Healthcare’s GRD Powder and GRD Mix as non-alcoholic beverages at 10%.
